SUBJECT: FINAL READING OF ORDINANCE NO. 2000-0-273

ADOPTING THE 2000 INTERNATIONAL FIRE CODE; RELATING TO THE INSPECTION ACTIVITIES OF THE CITY OF LAREDO, WEBB COUNTY, TEXAS AND ENFORCEMENT OF THE FIRE PREVENTION PROVISIONS AS PROVIDED IN SAID CODE, PROVIDING FOR THE ABATEMENT OF FIRE HAZARDS AND PROVIDING FOR PENALTIES FOR VIOLATIONS OF SAID CODES, REPEALING ALL  ORDINANCES INCONSISTENT WITH THIS CODE; AND ADDING OR AMENDING CERTAIN PROVISIONS OF THE 2000 INTERNATIONAL FIRE PREVENTION CODE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION.

PREVIOUS COUNCIL ACTION: In December 5, 1994 the City Council adopted the 1994 edition of the Standard Fire Prevention Code. (Ordinance 94-235).

 

 

BACKGROUND: The Southern Building Code Congress updates the Standard Fire Prevention Code every 3 years for the purpose of improving enforcement of Fire Prevention Provisions; provides for the abatement of Fire Hazards and for penalties for violations of the Code.  By adoption of these standards our community will become more safer.  The effective date of the Ordinance is upon publication.

ORDINANCE NO. 2000-0-273

 

ADOPTING THE 2000 INTERNATIONAL FIRE PREVENTION CODE; RELATING TO THE INSPECTION ACTIVITIES OF THE CITY OF LAREDO, WEBB  COUNTY, TEXAS AND ENFORCEMENT OF THE FIRE PREVENTION PROVISIONS AS PROVIDED IN SAID CODE, PROVIDING FOR THE ABATEMENT OF FIRE HAZARDS AND PROVIDING  FOR  PENALTIES FOR VIOLATIONS OF SAID CODES, REPEALING ALL ORDINANCES INCONSISTENT WITH THIS CODE; AND ADDING OR AMENDING CERTAIN PROVISIONS OF THE 2000 INTERNATIONAL FIRE PREVENTION CODE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING  FOR PUBLICATION.

 

            WHEREAS, The City is using the 1994 Standard Fire Prevention Code as amended through 1994; and

 

            WHEREAS, The City of Laredo Fire Chief recommends to Council and Council finds that it is the best interest of the Public to adopt the more recent version of the 2000 International Fire Prevention Code; and

 

            WHEREAS, The Council wishes to amend certain provisions of the 2000 International Fire Prevention Code to address local issues and concerns, such as use of CPVC (Chlorinated Poly Vinyl Chloride), sprinkler pipe and fittings in our incorporated area is prohibited; use of life safety code references in it’s entirety; Warehouses reopening as used clothing (rags) stores shall be fully sprinklered; and metal cans filled up at gasoline stations on vehicles with plastic bed liners is prohibited.

 

            NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO, TEXAS.

 

Section 1.        Adoption:  That the City of Laredo by and through its City Council, hereby adopts the 2000 edition of the International Fire Prevention Code in its entirety, save except such portions as are hereinafter deleted, modified, or amended, and the same is hereby adopted and incorporated herein as fully as if set out at length, and from the date on which this Ordinance shall take effect the provisions of the 2000 International Fire Prevention Code and the Ordinance shall be controlling within the corporate limits of the City of Laredo, Texas.

 

Section 2.        Amendments:  That the 2000 International Fire Prevention Code herein adopted is amended as follows:

(a)             CPVC (chlorinated poly vinyl chloride) sprinkler pipe and fittings will not be approved for use inside the City’s incorporated area.

(b)            Reference the use of the Life Safety Code 101 and handbook in its entirety.

(c)             Warehouses reopening as used clothing (rags) stores shall be fully sprinklered.

(d)            Metal cans filling up at gasoline stations on vehicles with plastic bed liners are prohibited.

(e)             The code is amended by deleting section 108,  and Section A101, entitled “Board of Appeals.”

 

Section 3.        Repeal:  All ordinances in conflict with this Ordinance and the Fire Prevention Code herein adopted are hereby repealed.

 

Section 4.        Penalty:  A violation of any provision or requirement of the 2000 International Fire Prevention Code or this Ordinance shall constitute a Class “C” misdemeanor and shall upon conviction be punishable by a fine of up to two thousand dollars ($2,000.00).

 

Section 5.        Publication:  This Ordinance shall be published once by the City Secretary in a newspaper of general circulation in the City of Laredo, and shall become effective upon publication.
