SUBJECT: FINAL READING OF ORDINANCE # 2000-O-292

Amending Ordinance No. 96-O-093  to reflect the new abutting property owners

being Mr. Daniel Garcia Jr. and wife Melida Garcia as the authorized buyers, instead of Imelda Yolanda Bustamante of the “Surface Only” of Parcel No. 3 - a 1,286.21 sq. ft. tract of land, more or less, comprised of  a portion of the north half of  Jarvis Avenue right-of-way between the south right-of-way of Sta. Barbara Street and the north right-of-way line of Sta. Clara Street, also bounded on the west and east by Block nos. 203 and 204 respectively, Eastern Division, as per the City of Laredo Original Land Grant, recorded in Volume 7, Page 15, Webb County Plat Records; and authorizing the City Manager to execute all necessary documents to effectively convey fee simple title of the “Surface Only” at its market value of said City property to Mr. Daniel Garcia Jr. and wife Melida Garcia who are now the current abutting property owners and providing for an effective date.

PREVIOUS COUNCIL ACTION:

On November 20, 2000 this Ordinance was introduced by the City Council.

BACKGROUND:

Ordinance No. 96-O-093 which authorized the sale of certain property described as a 1,286.21 sq. ft. tract of land, out of the south half of Jarvis Avenue right-of-way between Sta. Barbara and Sta. Clara Streets, situated in the Eastern Division, City of Laredo, Webb County, Texas; to the abutting property owners. Thereafter, Ms. Imelda Yolanda Bustamante, who was at the time the abutting property owner of the above mentioned section of Jarvis Street and one of the authorized buyers, sold her interest to the abutting property Mr. Daniel Garcia Jr. and wife Melida Garcia by a Warranty Deed recorded in Volume 831, Pages 212-213 of the Official Public Records of Webb County, Texas.  Said City property (Parcel No. 3) has been appraised by a State Certified Real Estate Appraiser at $3,537.07 (1,286.21 sq. ft. at $2.75 per square foot).  The City of Laredo will retain a 3’ wide by 46.30’ long utility easement for a total of 138.90 sq. ft.

 

In compliance with the Street Closing Sales Policy Handbook, the market value of the entire parcel being retained as a utility easement will be adjusted downward by 50%.  Therefore, $190.98 will be deducted and the adjusted market value is established at $3,346.00.

Staff requested the appraiser to review the appraisal report on this property and has determined that the market value of this street has not changed.

 

Mr. Daniel Garcia Jr. and wife Melida Garcia who are now the current abutting property owners to the above-mentioned former section of Jarvis Avenue have accepted the City’s offer to purchase the “Surface Only” of said City property which consists of 1,286.21 sq. ft. at the adjusted market value of $3,346.00.

 

This property is not on the tax rolls since the City of Laredo is the owner, the Webb County Tax Appraisal District has properties in the area valued at $2.00 and $2.03 per square foot.  On November 15, 2000, the Street Closing Committee was provided with the information through a memorandum.

 

Improvement Plan:

Resolution No. 97-R-140 requiring a potential buyer or lessee of a street to submit a property improvement plan is not applicable to this case since this property does not front a street.

OF THE SURFACE ONLY OF PARCEL NO. 3 - A 1, 286.21 SQ. FT.

TRACT OF LAND, MORE OR LESS, COMPRISED OF A

PORTION OF THE NORTH HALF OF JARVIS AVENUE

RIGHT-OF-WAY BETWEEN THE SOUTH RIGHT-OF-WAY

LINE OF STA. BARBARA ST. AND THE NORTH RIGHT-OF-WAY

LINE OF STA. CLARA ST. ALSO BOUNDED ON THE WEST

AND EAST BY BLOCK NOS. 203 AND 204, RESPECTIVELY,

EASTERN DIVISION, AS PER THE CITY OF LAREDO ORIGINAL

WHEREAS, Ordinance No. 96-O-093 authorizing the City Manager to execute all necessary documents to effectively convey title to Matias Romero and wife Leticia Raya Romero, Pedro Cruz Jr., Imelda Yolanda Bustamante, Israel Salazar and wife Maria G. Salazar, Daniel Garcia, Jr. and Jose Luis Garcia for the sale at fair market value of the “Surface Only” of that City property formerly known as Jarvis Avenue between Sta. Barbara and Sta. Clara Streets, situated in the Eastern Division, City of Laredo, Webb County, Texas; and,

 

WHEREAS, the sale of the above-mentioned Parcel No. 3 - a 1,286.21 sq. ft. tract of land, more or less, comprised of a portion of the north half of Jarvis Avenue never materialized; and,

 

WHEREAS, Ms. Imelda Yolanda Bustamante, the authorized buyer of the above-mentioned City property as per Ordinance No. 96-O-093, sold her interest to the abutting property to Daniel Garcia Jr. and wife Melida Garcia by a Warranty Deed recorded in Volume 831, Pages 212-213 of the Official Public Records of Webb County, Texas; and,

 

WHEREAS, Mr. Daniel Garcia Jr. and wife Melida Garcia who are now the current abutting property owners of the above-mentioned section of Jarvis Avenue

have accepted the City’s offer to purchase the “Surface Only” of said City property

at the adjusted market value of  $3,346.00; and,

 

           WHEREAS, it is in the City’s best interest to amend Ordinance No. 96-O-093

in order to reflect Mr. Daniel Garcia Jr. and wife Melida Garcia as the actual current abutting property owners and authorized buyers of that former section of Jarvis Avenue; and,

 

WHEREAS, it is in the City’s best interest to authorize the City Manager to execute all necessary documents to effectively convey fee simple title of the “Surface Only” at its market value of said City property to Mr. Daniel Garcia Jr. and wife Melida Garcia who are now the current abutting property owners.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

1.               Ordinance No. 96-O-093, is hereby amended to reflect the new abutting property owners being Mr. Daniel Garcia Jr. and wife Melida Garcia as the authorized buyers, instead of Imelda Yolanda Bustamante of the “Surface Only” of Parcel No. 3 - a 1, 286.21 sq. ft. tract of land, more or less, comprised of a portion of the north half of Jarvis Avenue right-of-way between the south right-of-way line of Sta. Barbara St. and the north right-of-way line of Sta. Clara St. also bounded  on the West and East by Block nos. 203 and 204, respectively, Eastern Division, as per the  City of Laredo Original Land Grant, recorded in Volume 7,  Page 15, Webb County Plat Records;

    

2.               The City Manager is hereby authorized to execute all necessary documents to effectively convey fee simple title of the “Surface Only” at its market value of said City property to Mr. Daniel Garcia Jr. and wife Melida Garcia who are now the current abutting property owners.

                       

3.                This ordinance shall become effective upon passage thereof.
