SUBJECT:  FINAL READING OF ORDINANCE #2000-O-293

Closing as a public easement a 60.0 foot strip of land out of a portion of Casa Verde Road between west right-of-way line of Loop 20 and the east right-of-way line of the new University Boulevard Extension.  Said 60.0 foot strip of land being situated in Porcion 26, Abstract 282, City of Laredo, Webb County, Texas; being generally described below and more particularly described by the metes and bounds on attached Exhibit “A”, provided that the City retains a 12 foot wide (23,224 square feet) Central Power and Light Company utility easement as described on the attached Exhibit “B” and providing for an effective date for the closure of the parcel and reversion of the public’s interest in said parcel to the abutting owner.

 

Being a strip of land generally 60.0 feet in width and containing 2.648 acres, more or less, out of that certain 1,450 acre tract more fully described in a conveyance from Delfina Benavides Alexander to Delfina Alexander Ochoa and Josefina Alexander Gonzalez, recorded in Volume 414, Pages 502-503, Deed Records, Webb County, Texas said strip of land being a portion of the Test Site Road also known as Casa Verde Road in the vicinity of its intersection with Loop 20, situated in Porcion 26, Abstract 282, Agustin Sanchez, Original Grantee, City of Laredo, Webb County, Texas.

PREVIOUS COUNCIL ACTION:

On November 20, 2000, this Ordinance was introduced by the City Council.

BACKGROUND:

The City of Laredo is proposing to close as a public easement the above-mentioned section of Casa Verde Road.  This road poses a very hazardous situation at its intersection with Loop 20, because it intersects the loop on an angle making it difficult to access this highway.  The City has negotiated the acquisition of the land needed for the University Boulevard Extension and both abutting property  owners have agreed on the proposed closure. The Killam family, abutting property owner to the east, has donated the land for the University Boulevard Extension.  While the Alexander Ochoa and  J. Alexander Gonzalez families, abutting property owners to the west, have agreed to donate a certain tract of land located west of the west right-of-way line of Loop 20 for a fire station, contingent upon the City closing the above mentioned tract.

BACKGROUND continued…

 

Upon the closing as a public easement the above-mentioned tract the City will revert the public’s interest in said tract to the Alexander family.  However, the City will retain an existing Central Power & Light Co. utility easement located on this tract. 

 

Memorandums were circulated to corresponding City Departments and utility companies and no objections were noted.

 

On August 17, 2000, a public hearing was held before the Planning and Zoning Commission.  Property owners within a 200’ radius were notified of the proposed street closing and no objections were voiced. The Planning and Zoning Commission voted unanimously in favor of the proposed closure.

 

On November 15, 2000, the Street Closing Committee was provided with the above information through a memorandum.

OF LAND OUT OF A PORTION OF CASA VERDE ROAD

BETWEEN THE WEST RIGHT-OF-WAY LINE OF LOOP 20

AND THE EAST RIGHT-OF-WAY LINE OF THE NEW

UNIVERSITY BOULEVARD EXTENSION. SAID 60.0 FOOT

STRIP OF LAND BEING SITUATED IN PORCION 26,

ABSTRACT 282, CITY OF LAREDO, WEBB COUNTY,

TEXAS; BEING GENERALLY DESCRIBED BELOW AND

MORE PARTICULARLY DESCRIBED BY THE METES AND

BOUNDS ON ATTACHED EXHIBIT “A”, PROVIDED THAT

THE CITY RETAINS A 12 FOOT WIDE (23,224 SQUARE FEET)

CENTRAL POWER AND LIGHT COMPANY UTILITY

SANCHEZ, ORIGINAL GRANTEE, CITY OF LAREDO, WEBB COUNTY,

TEXAS.

 

 

WHEREAS, the City Manager recommends that the City Council close as a public easement said 60.0 foot strip of land out of a portion of Casa Verde Road; and,

 

WHEREAS, with the completion of the new University Boulevard Extension Project, said portion of Casa Verde Road is no longer needed as a public easement; and, 

 

WHEREAS, the traffic flow will not be adversely affected by such closing; and,  

 

WHEREAS, upon closing as a public easement of said tract of land out of Casa

Verde Road the public’s interest in said tract will revert to the Alexander family, whose ownership has been established as per Howland Engineering Company Survey “retracement” of the original 1,450 acre Alexander tract; and,

 

WHEREAS, the City of Laredo will retain a 12 foot wide (23,224 sq. ft. tract of land) Central Power and Light Company utility easement; and,

 

WHEREAS, the City Council finds that it is in the best interest of the City to

close as a public easement said 60.0 foot strip of land out of a portion of Casa 

Verde Road.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

1.    A 60.0 foot strip of land out of a portion of Casa Verde Road between the

     west right-of-way line of Loop 20 and the east right-of-way line of the new    

     University Boulevard Extension, said 60.0 foot strip of land being situated in

     Porcion 26, Abstract 282, City of Laredo, Webb County, Texas; being

     generally described below and more particularly described by the metes and

     bounds on attached Exhibit “A” is hereby closed as a public easement

     provided that the City retains a 12 foot wide (23,224 sq. ft. tract of land) 

     Central Power and Light Company utility easement as described on the  

     attached Exhibit “B” 

 

Being a strip of land generally 60.0 feet in width and containing 2.648 acres,
