Proposed use: Correctional Facility
Site: The site is currently occupied by the Webb County Detention Center as a legal non-conforming use.
Surrounding land uses: All the surrounding areas are vacant and undeveloped.
Comprehensive Plan: This area is not identified in the Future Land Use Map.
Transportation Plan: The Long Range Thoroughfare Plan does not identify Renewal Ave. and Valley Blvd. which are the only two streets leading to this development.

The proposed zone change is not appropriate at this location. The existing correctional facility was constructed when this area was still outside the city limits and enjoys a legal non-conforming status.
Although the Comprehensive Plan does not recognize this area and the surrounding land is undeveloped, the approved River Valley Master Plan has the adjoining areas identified as single family residential. There are not similar type uses in the immediate area.
Staff does not support the proposed zone change but supports a C.U.P. with the following conditions:
1.) The C.U.P. is restricted to the correctional facility only.
2.) The C.U.P. is issued to the Webb County Correctional Center Public Facility Corp.
3.) The C.U.P. is nontransferable.

P&Z COMMISSION RECOMMENDATION:
The P & Z Commission, in a 7 to 0 vote and 1 abstention, recommended denial of the M-1 and approval of a Conditional Use Permit. |
Staff does not support the proposed zone change. Staff does support a C.U.P. for the proposed use. |
M-1 (Light Manufacturing District): The purpose of the M-1 is to encourage the development of manufacturing and wholesale business establishments which are clean, quiet and free of hazardous or objectionable elements such as noise, odor, dust, smoke or glare. Research activities are encouraged. This district is further designed to act as a transitional use between heavy industrial uses and other less intense and residential uses.
Is this change contrary to the established land use pattern?
This correctional facility is the only land use in the immediate area. The City of Rio Bravo is 360 ft. south of this property and the established land use pattern there is single family residential.
Would this change create an isolated zoning district unrelated to surrounding districts?
Yes, the entire area is zoned R-1.
Will change adversely influence living conditions in the neighborhood?
Yes, even though the surrounding areas are currently vacant, the approved River Valley Master Plan identifies the areas north and east of this site as single family residential.
Are there substantial reasons why the property can not be used in accord with existing zoning? The correctional facility currently enjoys legal non-conforming status. This type of use is not allowed in an R-1 Zone.

AMENDING THE ZONING ORDINANCE (MAP)
OF THE CITY OF LAREDO BY AUTHORIZING
THE ISSUANCE OF A CONDITIONAL USE
PERMIT FOR A CORRECTIONAL FACILITY ON
LOT 1, BLOCK 1, WEBB COUNTY DETENTION
CENTER PLAT, LOCATED NORTH OF THE
CITY OF RIO BRAVO AND WEST OF HWY. 83;
PROVIDING FOR PUBLICATION AND
EFFECTIVE DATE.
WHEREAS, the owner of Lot 1, Block 1, Webb County Detention Center Plat, located north of the City of Rio Bravo and west of Hwy. 83, has requested a zone change from R-1 (Single Family Residential District) to M-1 (Light Manufacturing District); and,
WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the Planning and Zoning Commission on this matter; and,
WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on October 19, 2000; and,
WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended denial of the proposed zone change and approval of a Conditional Use Permit; and,
WHEREAS, the City Council has held a public hearing on November 27, 2000, on the request and finds the proposed Conditional Use Permit for the area appropriate and consistent with the General Plan of the City of Laredo.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:
Section 1: The Zoning Map of the City of Laredo be and is hereby amended to authorize the issuance of a Conditional Use Permit for a correctional facility on Lot 1, Block 1, Webb County Detention Center Plat, located north of the City of Rio Bravo and west of Hwy. 83.
Section 2: The Conditional Use Permit is restricted to the following provisions herewith adopted by the City Council:
1.) The C.U.P. is restricted to the correctional facility only.
2.) The C.U.P. is issued to the Webb County Correctional Center Public Facility Corp.
3.) The C.U.P. is nontransferable.
Section 3: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.
Section 4: This ordinance shall become effective as and from the date of publication specified in Section 3.
