Site: The site is currently vacant.
Surrounding land uses: The area north of the site is single family residential. West of the site is the Col. Santos Benavides School. South of the site are the Eden Park Plaza, a Wendy's restaurant, and a Coastal Gas Station. Further south, beyond Del Mar Blvd., is an area of vacant and undeveloped land. East of the site are the Rainbow Play Systems, the Falcon National Bank, a McDonald's restaurant, and an H.E.B grocery store.
Comprehensive Plan: The Future Land Use Map recognizes this area as Low Density Residential and Retail/Office.
Transportation Plan: The Long Range Thoroughfare Plan does not recognize Eden Ln.

The proposed zone change is appropriate at this location. This lot is presently zoned B-3 and R-2; consequently, the proposed change will reconcile the different zoning designations within the lot. Furthermore, although there is a large residential area north of the site, there is an overhead C.P. & L. power easement running along the site's north and northeastern boundary which will serve as a buffer between the existing R-1 residential neighborhood and the proposed B-3 area.

B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.
Is this change contrary to the established land use pattern?
No, there is a trend toward commercial uses to the east and south of the site.
Would this change create an isolated zoning district unrelated to surrounding districts?
No, there is a B-3 zoned area directly east and south of the site. The areas directly north and west of the site are zoned R-1.
Will change adversely influence living conditions in the neighborhood?
No, the only neighborhood in the immediate vicinity is just north of the site, and as mentioned previously the C.P. & L. overhead power easement, located along the north, northeastern boundaries of the site, creates a buffer between this neighborhood and the propose B-3 zone area.
Are there substantial reasons why the property can not be used in accord with existing zoning? No, the existing zoning allows for sufficient uses that are compatible with the surrounding area.

AMENDING THE ZONING ORDINANCE (MAP) OF THE CITY OF LAREDO BY REZONING 8.795 acres out of Lot 3, Block 1, Del Mar North Filing No. One, as further described by metes and bounds on attached Exhibit "A", located at 302 Eden Ln., from R-2 (Multi-Family Residential District) to B-3 (Community Business District); PROVIDING FOR PUBLICATION AND EFFECTIVE DATE.
WHEREAS, the owner of 8.795 acres out of Lot 3, Block 1, Del Mar North Filing No. One, as further described by metes and bounds on attached Exhibit "A", located at 302 Eden Ln., has requested a zone change from R-2 (Multi-Family Residential District) to B-3 (Community Business District); and,
WHEREAS, notice of the zone change was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the Planning and Zoning Commission on this matter; and,
WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on July 19, 2001; and,
WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed zone change; and,
WHEREAS, the City Council has held a public hearing on August 27, 2001, on the request and finds the proposed zoning appropriate and consistent with the General Plan of the City of Laredo.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:
Section 1: The Zoning Map of the City of Laredo be and is hereby amended to change the current zoning designation of 8.795 acres out of Lot 3, Block 1, Del Mar North Filing No. One, as further described by metes and bounds on attached Exhibit "A", located at 302 Eden Ln., from R-2 (Multi-Family Residential District) to B-3 (Community Business District).
Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.
Section 3: This ordinance shall become effective as and from the date of publication specified in Section 2.
