    BACKGROUND
    Council District: I - Alfredo Agredano
    Proposed use: Commercial (no specific proposed use has been stated).
    Site: This site is currently vacant and undeveloped.
    Surrounding land uses: North and east of site are Lamrick, Las Palmas and Los Obispos subdivisions primarily devoted to single family residential uses. West and south of the site are vacant and undeveloped areas.
    Comprehensive Plan: The Future Land Use Map recognizes this area as Low Density Residential.
    Transportation Plan: The Long Range Thoroughfare Plan identifies Hwy. 83 as a Major Arterial and a Truck Route, and identifies Sierra Vista Blvd. as Minor Arterial.
    Letters sent to surrounding property owners: 21 In Favor: 0 Opposed: 0
    STAFF COMMENTS
    The proposed zone change is appropriate at this location. Though inconsistent with the Comprehensive Plan's designation for this area, the propose zone change is consistent with the surrounding zoning and the evident trend towards highly commercial uses along Highway 83. The site also meets the B-3 location requirement which stipulates that B-3 zoned areas be located primarily along minor or principal arterial streets, as classified by the Transportation Plan of the City of Laredo.
    P&Z COMMISSION RECOMMENDATION:
    The P & Z Commission, in a 6 to 2 vote, recommended approval of the zone change.
    STAFF RECOMMENDATION:
    Staff supports the proposed zone change.

    IMPACT ANALYSIS
    B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.
    Is this change contrary to the established land use pattern?
    Although there are residential areas north and east of the site, the areas east and south are largely vacant.
    Would this change create an isolated zoning district unrelated to surrounding districts?
    The adjoining zoning districts are AG, R-1MH and R-1.
    Will change adversely influence living conditions in the neighborhood?
    The residential areas in the vicinity shall be buffered by Sierra Vista Blvd. and by the necessary setbacks.
    Are there substantial reasons why the property can not be used in accordance with existing zoning? Yes, the existing AG zoning district does not allow for uses that are compatible with the surrounding area.

CITY OF LAREDO ORDINANCE NO. 2003-O-018

WHEREAS, a zone change has been requested by the owners of 6.0035 acres, as further described by metes and bounds on attached Exhibit "A", located east of Hwy. 83 and south of Sierra Vista Blvd., from AG (Agricultural District) to B-3 (Community Business District); and,

WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on December 19, 2002; and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed zone change; and,

WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

WHEREAS, the City Council has held a public hearing on January 13, 2003, on the request and finds the zone change appropriate and consistent with the General Plan of the City of Laredo; and,

WHEREAS, the City Council does not consider the impact, if any, of private covenants and deed restrictions on the subject property with the adoption of this ordinance; and,

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

Section 1: The Zoning Map of the City of Laredo be and is hereby amended by rezoning 6.0035 acres, as further described by metes and bounds on attached Exhibit "A", located east of Hwy. 83 and south of Sierra Vista Blvd., from AG (Agricultural District) to B-3 (Community Business District).

Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

Section 3: This ordinance shall become effective as and from the date of publication specified in Section 2.
