    Amending the Zoning Ordinance (Map) of the City of Laredo by authorizing the issuance of a Conditional Use Permit to the City of Laredo for the International Bridge I facility on All of Blocks L, M, N, and 21, and Lots 6C, 7C, 8C, 9C, & 10, Block 22, Western Division and that portion of Water St. between Juarez Ave. and Flores Ave., and that portion of Convent Ave. between Ventura St. and Zaragoza St., and that portion of Salinas Ave. between Ventura St. and Water St., commonly known as International Bridge I; providing for publication and effective date.     BACKGROUND
    Council District: VIII - Juan Ramirez
    Proposed use: The International Bridge I complex.
    Surrounding land uses: The areas north east and west of the site are occupied by a variety of commercial type uses and to the south area the Rio Grande River and vacant and undeveloped land.
    Comprehensive Plan: The Future Land Use Map recognizes this area as Institutional, Park/Recreational Open Space and Retail/Office.
    Transportation Plan: The Long Range Thoroughfare Plan identifies Salinas Ave., Convent Ave. and Zaragoza St. as Major Collectors.
    Letters sent to surrounding property owners: 34 In Favor: 2 Opposed: 0
    STAFF COMMENTS
    Staff supports the issuance of the proposed Conditional Use Permit. Staff has reviewed the proposed Bridge I complex renovations and improvements and find that they comply with all Conditional Use Permit standards regarding suitability, timeliness, compatibility, and code conformance, etc. Staff therefore recommends the authorization of said permit.
    Conditional Use Permit - a permit granted solely on a discretionary and conditional basis by the City Council, which authorizes a land use in a zoning district in which that use is not normally permitted. All requirements of a Conditional Use Permit are in addition to and supplemental land development code requirements.
      P&Z COMMISSION RECOMMENDATION:
      The P & Z Commission, in a 6 to 0 vote, recommended approval of the zone change.
      STAFF RECOMMENDATION:
      Staff supports the proposed Conditional Use Permit.

      IMPACT ANALYSIS
      Conditional Use Permit - a permit granted solely on a discretionary and conditional basis by the City Council, which authorizes a land use in a zoning district in which that use is not normally permitted. All requirements of a Conditional Use Permit are in addition to and supplemental land development code requirements.
      R-1 (Single Family Residential District): The purpose of the R-1 District is to provide an area for residential uses and those public and semipublic uses normally considered an integral part of the neighborhood they serve.
      Is the use contrary to the established land use pattern?
      Yes, the established land use pattern is residential other than the church.
      Are there substantial reasons why the property can not be used in accord with existing zoning? No, the current zoning allows for sufficient uses that are compatible with the immediate surrounding area.

    WHEREAS, the applicant has requested the issuance of a Conditional Use Permit to the City of Laredo for the International Bridge I facility on All of Blocks L, M, N, and 21, and Lots 6C, 7C, 8C, 9C, & 10, Block 22, Western Division and that portion of Water St. between Juarez Ave. and Flores Ave., and that portion of Convent Ave. between Ventura St. and Zaragoza St., and that portion of Salinas Ave. between Ventura St. and Water St., commonly known as International Bridge I; and,

    WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on January 23, 2003; and,

    WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed Conditional Use Permit amendment; and,

    WHEREAS, notice of the amendment request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

    WHEREAS, the City Council has held a public hearing on February 18, 2003, on the request and finds the proposed amendment appropriate and consistent with the General Plan of the City of Laredo.

    WHEREAS, the City Council does not consider the impact, if any, of private covenants and deed restrictions on the subject property with the adoption of this ordinance; and,

    NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

    Section 1: The Zoning Map of the City of Laredo be and is hereby amended by authorizing the issuance of a Conditional Use Permit to the City of Laredo for the International Bridge I facility on All of Blocks L, M, N, and 21, and Lots 6C, 7C, 8C, 9C, & 10, Block 22, Western Division and that portion of Water St. between Juarez Ave. and Flores Ave., and that portion of Convent Ave. between Ventura St. and Zaragoza St., and that portion of Salinas Ave. between Ventura St. and Water St., commonly known as International Bridge I.

    Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

    Section 3 :: This ordinance shall become effective as and from the date of publication specified in Section 2.
