    Amending the Zoning Ordinance (Map) of the City of Laredo by rezoning All of Block 1477 and an 8,112.59 square foot tract of land out of the Milmo Ave. right-of-way between the south right-of-way line of Blaine St. and the north right-of-way line of Loop 20, situated in the Eastern Division, located at approximately the 800 block of Texas Ave., from R-2 (Multifamily Residential District) to B-3 (Community Business District); providing for publication and effective date.     BACKGROUND
    Council District: II - Hector J. Garcia
    Proposed use: Commercial (possibly a mini-storage warehouse facility).
    Note: The proposed use requires the applicant to seek a Special Use Permit which will be heard by the Commission during the following agenda item.
    Site: The site is currently vacant.
    Surrounding land uses: The site is located on Loop 20 and the area surrounding the site is occupied by two vacant blocks and a mixture of both residential and commercial uses. The commercial uses in the area are found mostly along Loop 20 and Zapata Hwy. and include Gateway Metal, the Smoking Dog, a two used car lots, a Citgo gas station, a beer-run, a saddlery, a daycare, the Bearing Supply Company, and a tire shop. The residential uses in the area include single family, multifamily, and manufactured residences.
    Comprehensive Plan: The Future Land Use Map recognizes this area as Retail/Office.
    Transportation Plan: The Long Range Thoroughfare Plan does not recognizes Texas Ave., but it does identify Loop 20 as a Major Arterial and a Truck Route.

    STAFF COMMENTS
    The proposed zone change is appropriate at this location. The proposed change is not only consistent with the Comprehensive Plan and the surrounding zoning trend, but is also highly compatible to this location, as this site directly abuts Loop 20, identified by the Long Range Thoroughfare Plan as a Major Arterial and a Truck Route.
    P&Z COMMISSION RECOMMENDATION:
    The P & Z Commission, in a 8 to 1 vote, recommended approval of the zone change.
    STAFF RECOMMENDATION:
    Staff supports the proposed zone change.

    IMPACT ANALYSIS
    B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.
    Is this change contrary to the established land use pattern?
    The established land use pattern is a mixture of both commercial and residential uses.
    Would this change create an isolated zoning district unrelated to surrounding districts?
    No, the adjoining zoning districts are B-3, and R-2.
    Will change adversely influence living conditions in the neighborhood?
    The area has already evidenced a trend towards commercial zoning especially along the Loop, which indicates a transition from residential to commercial uses.
    Are there substantial reasons why the property can not be used in accord with existing zoning? No, though the current zoning allows for sufficient uses somewhat compatible with the surrounding area, the proposed zone furthers the trend toward commercial uses long the Loop.

CITY OF LAREDO ORDINANCE NO. 2003-O-112

WHEREAS, a zone change has been requested by the owners of All of Block 1477 and an 8,112.59 square foot tract of land out of the Milmo Ave. right-of-way between the south right-of-way line of Blaine St. and the north right-of-way line of Loop 20, situated in the Eastern Division, located at approximately the 800 block of Texas Ave., from R-2 (Multifamily Residential District) to B-3 (Community Business District); and,

WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on March 20, 2003; and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed zone change; and,

WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

WHEREAS, the City Council has held a public hearing on April 21, 2003, on the request and finds the zone change appropriate and consistent with the General Plan of the City of Laredo; and,

WHEREAS, the City Council does not consider the impact, if any, of private covenants and deed restrictions on the subject property with the adoption of this ordinance; and,

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

Section 1: The Zoning Map of the City of Laredo be and is hereby amended by rezoning All of Block 1477 and an 8,112.59 square foot tract of land out of the Milmo Ave. right-of-way between the south right-of-way line of Blaine St. and the north right-of-way line of Loop 20, situated in the Eastern Division, located at approximately the 800 block of Texas Ave., from R-2 (Multifamily Residential District) to B-3 (Community Business District).

Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

Section 3: This ordinance shall become effective as and from the date of publication specified in Section 2.
