    BACKGROUND
    Council District: II - Hector J. Garcia
    Proposed use: Commercial (No specific use has been stated.)
    Site: The site is currently vacant and undeveloped.
    Surrounding land uses: The site is surrounded by vacant and undeveloped land with the exception of Larga Vista and Fiesta subdivisions north of the site.
    Comprehensive Plan: The Future Land Use Map recognizes this area as High Density Residential.
    Transportation Plan: The Long Range Thoroughfare Plan identifies Hwy. 359 as a Super Street at this location.
    Letters sent to surrounding property owners: 10 In Favor: 2 Opposed: 0
    STAFF COMMENTS
    The proposed zone change is inappropriate at this location as it is inconsistent with the Future Land Use Map's High Density Residential designation of this site. Furthermore, Staff is opposed to placing a B-4, an extremely intensive commercial designation, adjacent to the residential area proposed to the south without the benefit of any transitionally zoned areas between the two.
    Although Staff finds the proposed zone change unacceptable, Staff will support a B-3 (Community Business District) designation at this location.
      P&Z COMMISSION RECOMMENDATION:
      The P & Z Commission, in a 7 to 1 vote, recommended denial of the proposed B-4 and approval of a B-3 zone change.
      STAFF RECOMMENDATION:
      Staff recommends does not support the proposed zone change but supports a B-3 zone change.

      IMPACT ANALYSIS
      B-4 (Highway Commercial District): The purpose of the B-4 District is to provide for those businesses and services serving a regional area which are to be located primarily along principal (major) arterial streets or the freeway, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.
      Is this change contrary to the established land use pattern?
      The only established land use pattern in the area is to the north of the site, and consists of mainly single family residences.
      Would this change create an isolated zoning district unrelated to surrounding districts?
      Yes, the adjoining zoning districts are R-1, B-3, and B-4.
      Will change adversely influence living conditions in the neighborhood?
      The B-4 would definitely negatively impact the proposed residential areas to the south.
      Are there substantial reasons why the property can not be used in accord with existing zoning? No, the current zoning allows for sufficient uses compatible with the surrounding area although a commercial designation would be more appropriate considering it's proximity to Hwy 359.

      CITY OF LAREDO ORDINANCE NO. 2003-O-127

      WHEREAS, a zone change has been requested by the owners of 4.6243 acres, as further described by metes and bounds on attached Exhibit "A", located south of Hwy. 359 and approximately one and a half miles east of Loop 20, from R-1 (Single Family Residential District) to B-4 (Highway Commercial District); and,

      WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on April 17, 2003; and,

      WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended denial of the proposed B-4 and approval of a B-3 zone change; and,

      WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

      WHEREAS, the City Council has held a public hearing on May 19, 2003, on the request and finds the zone change appropriate and consistent with the General Plan of the City of Laredo; and,

      WHEREAS, the City Council does not consider the impact, if any, of private covenants and deed restrictions on the subject property with the adoption of this ordinance; and,

      NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

      Section 1: The Zoning Map of the City of Laredo be and is hereby amended by rezoning 4.6243 acres, as further described by metes and bounds on attached Exhibit "A", located south of Hwy. 359 and approximately one and a half miles east of Loop 20, from R-1 (Single Family Residential District) to B-3 (Community Business District).

      Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

      Section 3: This ordinance shall become effective as and from the date of publication specified in Section 2.
