21.      Public hearing and introductory ordinance concerning an application by Transborder Investment, L.L.C., altering and extending the boundary limits of the City of Laredo, annexing additional territory of 27.59 acres of land, more or less, located north of Highway 359 and east of Coronado Avenue, as further described by metes and bounds in Attachment “A”, specifically Transborder Tract, providing for the effective date of the ordinance, authorizing the City Manager to execute a contract adopting a service plan for the annexed territory, and establishing the initial zoning of R-1A (Single-Family Reduced Area District).             

 

22.      Public hearing and introductory ordinance concerning an application by Humberto Treviño, altering and extending the boundary limits of the City of Laredo, annexing additional territory of 4.51 acres of land, more or less, located north of Highway 359 and west of the U.I.S.D. Student Activity Complex, as further described by metes and bounds in Attachment “A”, specifically Treviño Tract, providing for the effective date of the ordinance, authorizing the City Manager to execute a contract adopting a service plan for the annexed territory, and establishing the initial zoning of R-2 (Multi-Family Residential District) for 2.91 acres and B-4 (Highway Commercial District) for 1.6 acres.                                                                                                                                                                                                    

 

23.      Public hearing and introductory ordinance amending the City of Laredo Code of Ordinance as follows: Chapter 2, Article II, Division 3, Section 2-61(a) Military leave, subsection (3) and adding subsection (4), to allow the City of Laredo to supplement military base pay with the difference between the employee’s military base pay and the employee’s base pay from his/her employment with the City of Laredo, after all military leave, annual leave and/or compensatory time have been exhausted.

 

24.      Public hearing and introductory ordinance amending the FY 2004 – 2005 Annual Operating Budget in the Laredo Fire Department EMS Division Budget by accepting a donation of $1,500.00 from Wal-Mart Stores and appropriating said funds for the purpose of purchasing a new computer system with Emergency Medical Testing Software for the EMS Division.

 

25.      Public hearing and introductory ordinance amending the City of Laredo FY 2004-2005 Annual Budget by appropriating   revenues and expenditures in the amount of $10,000.00 in additional funds for a grand total of $32,000.00 from the University of Arizona for the Border Vision Fronteriza (BVF) 2: Community Health Workers for Children’s Health Project of the City of Laredo Health Department, and extending the program period from September 14, 2003 through September 13, 2004, to September 14, 2003 through March 13, 2005.

 

26.      Public hearing and introductory ordinance authorizing the City Manager to amend the City of Laredo FY 2004-2005 Annual Budget by appropriating unexpended fund balances in the amount of $14,525.00 from FY 2003-2004 and appropriate new funds from both districts in the amount of $56,385.00 for the total amount of $70,910.00 from the Laredo Independent School District and the United Independent School District contracts for the Immunization Program of the City of Laredo Health Department for the period beginning October 1, 2004 through September 30, 2005.

 

27.      Public hearing and introductory ordinance authorizing the City Manager to amend the City of Laredo FY 2004-2005 Annual Budget by decreasing revenues and expenditures in the amount of $4,846.00 from the Texas Department of State Health Services to reflect the actual grant amount  of $17,889.00 for the Binational TB Card Pilot Project of the City of Laredo Health Department for the contract period beginning November1, 2004 through September 30, 2005; and authorizing the City Manager to execute the contract.

 

28.      Public hearing and introductory ordinance accepting a supplemental grant awarded and amending the City of Laredo FY 2004 – 2005 Budget by increasing revenues and expenses in the amount of $80,000.00 for an Interdiction Project awarded by the Office of the National Drug Control Policy (ONDCP) High Intensity Drug Trafficking Area (HIDTA). Funds will be used to pay overtime expenses for a drug interdiction unit compromised of Financial Task Force agents and Laredo Police Officers from January 1, 2004 through December 31, 2004. Funds for fringe benefits are already appropriated in the program income accounts.

 

29.      Public hearing and introductory ordinance authorizing the City Manager to enter into an agreement with the Laredo Housing Authority in the amount of $25,000.00 and amending the City of Laredo FY 2004-2005 Annual Budget by the same amount. The agreement’s purpose is to reimburse costs for overtime incurred by the Laredo Police Department officers in providing resources for the Weed and Seed Community Building Program.  This overtime will be reimbursed at no cost to the city.  The term of this agreement is from October 1, 2004 through September 30, 2005.

 

30.      Public hearing and introductory ordinance amending the City of Laredo FY2004-2005 Annual Budget by reducing revenues in the amount of $8,940.00 and reducing expenditures in the amount of $2,318.00 for a total budget amendment of $11,258.00 for a grant awarded by the Office of the Governor, Criminal Justice Division in the amount of $36,118.00 for the Juvenile Accountability Grant program. The Office of the Governor is contributing $36,118.00 with the City designating $12,327.00 in matching funds for a total grant amount of $48,445.00.  This funding will be used for the Juvenile Accountability Block Grant Program for the period of August 01, 2004 through July 31, 2005

 

31.      Public hearing and introductory ordinance amending the City of Laredo FY 2004-2005 Annual Budget by increasing expenditures and revenues in the amount of $727,200.00 in overtime for Operation Stonegarden. The United States Customs and Border Protection Service (CBP) will reimburse this full amount for overtime expenses incurred by police officers working under the homeland security parameters of Operation Stonegarden. (Need approval of Resolution No. 2004-R-115)

 

32.      Public hearing and introductory ordinance amending the City of Laredo FY 2005 Airport Fund (Operating) and Airport Construction Fund Budgets by appropriating $2,327,250.00 and $1,500,000.00 respectively.  Airport Fund will be amended by drawing down $2,327,250.00 from the Airport’s Opening Fund balance and increasing the appropriate expenditure line items by $2,327,250.00 to cover the cost of multiple airport projects;  the Airport Construction Budget will be amended by increasing revenue and expenditure line items by $1,500,000.00 to reserve the local match funding needed for future Airport Improvement Program and TxDOT Grants; and authorizing the City Manager to implement said budget amendments; providing for an effective date.

 

33.      Public hearing and introductory ordinance amending Ordinance No. 99-O-077, Exhibits “A” and “B” of the Water Line Reimbursement Agreement for Hilltop Subdivision, Phase II, by amending start date from March 15, 1999 to November 15, 2004, in order to reflect effective time to add interest  to the balance owed by the future connectors.

 

34.      Public hearing and introductory ordinance amending  Ordinance No. 99-O-078, Exhibits “A” and “B” of the Sewer Line Reimbursement Agreement for Hilltop Subdivision, Phase II, by amending start date from March 15, 1999 to November 15, 2004, in order to reflect effective time to add interest to the balance owed by the future connectors.

 

35.      Public hearing and introductory ordinance amending Ordinance No. 99-O-244 of the City of Laredo, updating water conservation and drought contingency plans providing for severability and an effective date.

 

36.      Public hearing and introductory ordinance authorizing the City Manager to implement a southbound pedestrian toll free crossing for the period of December 17th through December 24th, 2004.

 

37.      Public hearing and introductory ordinance amending the City of Laredo Code of Ordinance Chapter 21, Offenses and Miscellaneous Provisions, Article XII, Aggressive Solicitation, by adding definitions, prohibiting solicitors from entering roadways while collecting contributions, authorizing police officer and code enforcement officers to halt ongoing solicitation as a penalty for violating any provision of this ordinance; providing for publication and effective date.

38.      Closing as public easements those sections of Jarvis Avenue between Marion and Gates Streets (including its intersection with Gates Street) and Gates Street between Jarvis and Martin Avenues all situated in the Eastern Division, City of Laredo, Webb County, Texas, and providing for an effective date.

 

39.      Authorizing the City Manager to execute all necessary documents to effectively convey a 454.71 square foot easement and right of way to AEP Texas Central Company, to serve the City of Laredo Landfill Water Tank on State Highway 359. Said 454.71 square foot easement and right of way being situated in Porcion 32, Abstract 3116, City of Laredo, Webb County Texas; providing for an effective date.

 

40.      Closing as a public easement that section of Chihuahua Street between Texas Avenue and east right-of-way line of U.S. Highway 83 situated in the Eastern Division, City of Laredo. County of Webb, Texas, and providing for an effective date.

 

41.      Setting the maximum speed limit on that portion of I.H. 35 Main Lane, north and south direction, within the City Limits of Laredo, Webb County, Texas, as 55 MPH from mile point 7.401 to mile point 7.613 and 60 MPH from mile point 7.613 to mile point 8.351, located approximately between Shiloh and Loop 20, as defined in the Texas Department of Transportation control section map 0018-06-138, providing for the installation of appropriate signs to indicate speed changes in the designated areas and providing for publication and effective date.

2004-O-280                       Amending the City of Laredo FY 2004 – 2005 Annual Budget by increasing revenues and expenditures in the amount of $39,153.00 in additional funds from the Texas Department of State Health Services for a total grant in the amount of $208,446.00 for the Tuberculosis Prevention/Control Federal Project of the City of Laredo Health Department for the period beginning January 1, 2004 through December 31, 2004.

 

2004-O-281                       Authorizing the City Manager to amend the City of Laredo FY 2004 – 2005 Annual Budget by decreasing revenues and expenditures in the amount of $58,148.00 from the Texas Health and Human Services Commission to reflect the actual grant amount of $35,157.00 for the Children’s Health Insurance Program (CHIP) Outreach Project of the City of Laredo Health Department for the period beginning September 1, 2004 through April 30, 2005; and authorizing the City Manager to execute the contract.

 

2004-O-282                       Authorizing the City Manager to enter into an agreement between Texas Engineering Extension Service/ Emergency Services Training Institute (TEEX) and the City of Laredo Fire Department to define the responsibilities for both parties for the educational/instructional activities to be offered to Firefighters, non Firefighter trainees and out-of-country first responders at the Laredo International Fire/Law Enforcement Training Center.

 

2004-O-283                       Authorizing the City Manager to enter into an agreement with the Texas Forest Service to accept a grant in the amount of $25,000.00, with a 50 % local match for the hiring of a City Forester within the Parks and Recreation Department and amending the City of Laredo FY 2004 – 2005 General Fund Budget by appropriating revenues of $25,000.00 in the form of a grant from the Texas Forest Service and appropriating expenditures in the amount of $25,000.00. Local match of $25,000.00 will be appropriated from the Parks and Recreation Department Budget.

 

2004-O-284                       Amending Section 23-3 and Section 23-5 of Chapter 23 (Parks and Recreation) of the Code of Ordinances of the City of Laredo to allow for rate changes in public swimming pool instructional fees, the addition of new recreation center membership fees, program fees and league fees; and amending the City of Laredo FY 2004 – 2005 General Fund Budget by appropriating revenues and expenditures in the amount of $100,000.00 for the new summer program fees and annual membership fees; providing for publication and effective date.

 

2004-O-285                       Ratifying the City Manager’s acceptance of a grant by the United States Environmental Protection Agency in the amount of $30,000.00 with the City designating $1,579.00 in matching funds for a total of $31,579.00 and amending the City of Laredo’s FY 2004-2005 Annual Budget for the NPDES Fund by appropriating the said grant revenue to the appropriate expenditure accounts.  The grant monies will be used to educate children, 3-5 years of age in Laredo, Texas and Nuevo Laredo, Tamps., Mexico on environmental issues.  Matching funds are available in the NPDES fund.

   

2004-O-286                       Authorizing the City Manager to execute a contract by and on behalf of the City of Laredo, Zone Grantee of Foreign-Trade Zone No. 94, and authorizing the City Manager to enter into an Operations Agreement with AZ Logistics, LLC, Zone Site Operator, to activate approximately 19,000 square feet of warehouse space and 4,500 square feet of yard area located at 1209 Uniroyal Dr., at Foreign-Trade Zone No. 94, Site 6, effective upon execution of this contract and ending on October 31, 2009. Providing activation, administration and transaction fees be paid to the city and providing for an effective date.

 

2004-O-287                       Appointing Edward F. Maddox as Associate Municipal Court Judge to a two (2) year term and reappointing Judge Juan B. Caballero to a new two (2) year term as per the requirement of the Charter of the City of Laredo, Article V, Section 5.02.

 

2004-O-288                       Authorizing the City Manager to execute a lease with United Exports Trading Association (U.E.T.A.) of Texas, Inc. for approximately 9,578.54 square feet situated in Webb County, Texas, and being the Surface only of the North 43.1 feet of Lots Number Six (6), Seven (7), Eight (8), and Nine (9) [N.43.1’ of Lots 6-9], in Block Number Twenty-two (22), Western Division of the City of Laredo, save and except that portion of Lot Six (6) conveyed to the City of Laredo on July 1, 1927, by instrument recorded in Volume 105, Page 132, Webb County Deed Records. (As Amended)

1.      Lease term is for one (1) year commencing on August 1, 2004 and ending on July 31, 2005.

2.      Monthly rent will be $9,132.00.

3.      City of Laredo may terminate this lease within sixty (60) days written notice.

 

2004-O-289                       Amending the City of Laredo’s FY 2004-2005 Annual Budget by appropriating expenditures in the amount of $338,280.00 from opening balance in the Police Department Trust Fund and appropriating $443,069.00 from the Capital Proceeds line item. Funding will be used for various items including a lease purchase of Mobile Data Terminals (MDT’s), the purchase  of the maintenance contract and licensing fees for these MDT’s, the purchase and upgrade of computers, the purchase of rape kits and the purchase of traffic gear and tools. Funding is available in the Police Trust Fund Budget.

 

2004-O-290                       Authorizing the City Manager to accept a grant in the amount of $15,000.00 from the Texas Department of Transportation for an Occupant Protection and Traffic Enforcement by which the City will pay for the fringe benefits in the amount of $4,200.00 and authorizing the City Manager to amend the City of Laredo’s FY 2004-2005 Annual Budget in the amount of $15,000.00.  This grant is for overtime and is funded by the Texas Department of Transportation. The City of Laredo will pay for the 10% match requirement plus $2,700.00 for fringe benefits. Funding is available through a transfer from General Fund.

 

X.        RESOLUTIONS

           

43.      2004-R-103      To adopt in its present form the Equal Employment Opportunity / Affirmative Action Plan, thereby ensuring that the City actively seeks and hires the best qualified applicants for the job regardless of race, color, religion, creed, sex, national origin, disability or age. 

 

44.      2004-R-115      Accepting an overtime agreement award for $727,200.00 from the United States Customs and Border Patrol Protection Service (CBP), United States Department of Homeland Security. The United States Customs and Border Protection Service will reimburse this full amount for overtime expenses incurred by police officers working under the homeland security parameters of Operation Stonegarden.

 

45.      2004-R-116      Authorizing the City Manager to accept a grant in the amount of $112,280.00 from the Texas Department of State Health Services for the Prevention Services for HIV-Infected Persons Project (PSHIP) of the City of Laredo Health Department for the contract period beginning January 1, 2005 through December 31, 2005, and authorizing the City Manager to execute the contract.

 

46.      2004-R-117      Declaring the public necessity to acquire the “Surface Only” of four parcels of land for the Highway 359 Acquisition and Relocation Project. Said four parcels being Lots 4, 5, 6, & 7, Block 1868, Eastern Division, City of Laredo, Webb County, Texas, as delineated on attached copy of City Plat; and authorizing staff to negotiate with the owners for the acquisition of said parcels by purchase at market values to be established by a State Certified Real Estate Appraiser, and further authorizing the City Attorney to initiate condemnation proceedings to acquire said parcels if staff is unable to acquire due to inability to agree to a purchase price, conflict of ownership, owner refusal to sell, and/or inability to locate a listed owner.

 

47.      2004-R-118      Declaring the public necessity to acquire one parcel of land as a Utility Easement for the Chacon Creek Interceptor Project, Phase II.  Said parcel being a variable width easement containing 2.092 acres, more or less, and being situated in Abstract 422, Survey Number 1284, and Abstract 517, Survey Number 1714, City of Laredo, Webb County, Texas; and authorizing staff to negotiate for the acquisition of said parcel by purchase at a market value to be established by a State Certified Real Estate Appraiser, and further authorizing the City Attorney to initiate condemnation proceedings to acquire said parcel if staff is unable to acquire through negotiations due to inability to agree to a purchase price, conflict of ownership, owner refusal to sell, and/ or inability to locate the listed owner.

 

48.      2004-R-120      Authorizing the use of surplus proceeds from the City of Laredo – Public Property Finance Contractual Obligations (PPFCO), Series 2002A, in the amount of $202,000.00, for the purchase of one hundred and twenty (120) replacement sets of protective clothing (bunker gear) for structural fire fighting and one (1), heavy duty washer for the Fire Department.

 

XI.       MOTIONS

 

49.      Authorizing the City Manager to enter into a Phase I contract with Sole Source provider, TransCore LP., to provide an upgraded electronic toll collection system “Hardware & Software” for the Bridge of the Americas project, “El Portal”, in an initial amount not to exceed $1,497,910.00. Funding is available in Revenue Bond Series 2004 Machinery & Equipment Account. 

 

50.      Consideration for approval to rescind the contract awarded to Matrix Security Systems, Inc., Dayton, Ohio, on September 27, 2004, since the contractor is not able to fulfill the bond requirements as stipulated by the contract documents for the Laredo International Airport Security Related Improvements Project.  Funding is available in the Airport Construction Fund - Grant 34 and Land and Development Division.

 

51.      Consideration to award a construction contract to the lowest bidder meeting bid document requirements Zertuche Construction Company, Laredo, Texas, in the bid amount of $364,855.00 for the Farias Community Center.  Funding is available in the Community Development Block Grant -Community Center - 29th and 30th Action Year - 2003 and 2004 Grants.

 

52.      Consideration for approval to reject the two bids received for the Eastwoods Park Phase II, since both bids are over the budget allotted.  Staff recommends that the park be constructed in-house by Engineering/Public Works and Parks and Recreation Departments. Funding is available in the Capital Improvement Fund - Eastwood Park Project.  

 

53.      Consideration for approval of acceptance of the Zacate Creek Irrigation Project located between Saunders and Lyon Street, west of Zacate Creek and approval of final payment in the amount of $6,280.00 to Olympia Landscape Irrigation & Lawn Service, Laredo, Texas.  Final contract amount is $62,800.00.  Funding is available in the Zacate Creek Irrigation.

 

54.      Consideration to award a professional services contract to Arcadis, Laredo, Texas, in the amount not to exceed $41,000.00 for design and preparation of plans and specifications for the Hillside/McPherson Intersection.  Funding is available in the Transit System - Combination Tax and Revenue Certificate 2004 - Improvements Other Than Buildings.

 

55.      Consideration to award a professional services contract to Premier Civil Engineering, Laredo, Texas, in the amount not to exceed $31,400.00 for design and preparation of plans and specifications for the Bartlett/Saunders Intersection, and the Bartlett/Market Intersection.  Funding is available in the Transit System Combination Tax and Revenue Certificate 2004 - Improvements Other Than Buildings.

 

56.      Consideration to award a professional services contract to Porras Engineering Company, Laredo, Texas, in the amount not to exceed $37,300.00 for design and preparation of plans and specifications for the Santa Maria Avenue Reconstruction (Industrial Boulevard to Del Mar).  Funding is available in the Transit System Combination Tax and Revenue Certificate 2004.

 

57.      Consideration for approval of the selection of consultant Freese and Nichols, Fort Worth, Texas,  for the Construction, Reconstruction and Rehabilitation of Airport Pavement Areas and other Aeronautical Improvements at the Laredo International Airport and authorization to negotiate a professional services contract. Funding is available in the  Airport Fund.

 

58.      Consideration for approval of change order no.1 an increase of $359,457.65 to the construction contract with Price Construction, Ltd., Laredo, Texas, for the Laredo International Airport Reconstruction of Portions of Taxiways A and B – AIP Project No. 3-48-0136-41-04 for additional construction on Taxi- way Delta at Runway 14-32 and to add thirty (30) calendar days to the construction contract time.  Funding is available in the Airport Construction Fund/Grant 41.

 

59.      Authorizing the City Manager to enter into a contract and award 2004 HOME Investment Partnerships Program, Community Housing Development Organization (CHDO) funds made available by the U.S. Department of Housing and Urban Development (HUD) in the amount of $140,000.00 to Habitat for Humanity of Laredo, Inc., for the cost associated with soft costs and site work for 20 homes which will be constructed on land donated along HWY 359. These funds will be used as part of Phase I of a Colonia Alternative Community. The homes will be made available to households earning between 25% - 60% of the area median income.

 

60.      Authorizing the City Manager to enter into contract and award 2004 HOME Investment Partnerships Program, Community Housing Development Organization (CHDO) funds made available by the U.S. Department of Housing and Urban Development in the amount of $76,601.00 to Laredo Webb Neighborhood Housing Services, Inc. (NHS) for the acquisition of residential lots in the Cielito Lindo Subdivision – Phase VII on which affordable single-family housing units will be constructed.  The homes will be made available to first-time homebuyers who earn 80% or less of the Housing Area Median Family Income (HAMFI).

 

61.      Authorizing the City Manager to enter into contract and award 2004 Emergency Shelter Grant funds (ESG) made available by the U.S. Department of Housing and Urban Development in the amount of $58,000.00 to Sacred Heart Children’s Home for the operation of Sacred Heart Children’s Home; $44,105.00 to the Laredo Homeless Coalition (LHC) for the operation of the Guadalupe and Lilia Martinez Resource Center, $15,000.00 to Casa De Misericordia for the operation of Case De Misericordia; $20,000.00 to Bethany House for Homeless Prevention assistance; and $20,000.00 to the Laredo Webb County Community Action Agency (CAA) for Homeless Prevention assistance.

 

62.      Authorizing the purchase and installation of one complete sports lightning system for the Taylor Little League Park from Musco Lighting System in the amount of $126,882.00.  Funding is available in the 29th and 30th Action Year Community Development Block Grants (CDBG).

 

63.      Authorizing the City Manager to negotiate and execute a contract with the Laredo Chamber of Commerce to share in the cost of operation of the Laredo Trade and Travel Center located in Monterrey, Nuevo Leon, with an October 1, 2004 effective date.  The total cost to the City of Laredo is $50,000.00.  Funding is available in the Laredo Convention & Visitors Bureau FY 2004 – 2005 Budget.

 

64.      Consideration to award annual contract FY05-008 to the low bidders, Dooley Tackaberry, Inc., Deer Park, TX, Municipal Emergency Services Inc., Houston, TX, Ferrara Fire Apparatus, Holden, LA, and NAFECO/Wilson Fire, New Braunfels, TX for the purchase of tools and equipment used by the Fire Department. Funding is available in the Fire Department Budget.

 

65.      Consideration to reject the two proposals submitted for the Civic Center food and beverage concession contract and authorizing staff to solicit new proposals.

 

66.      Authorizing the issuance of a Request for Proposals (RFP) for the Railroad Quiet Zone Study.  The MPO has budgeted $90,000.00 for the project, and funding is available through the MPO account.

 

67.      Authorizing the issuance of a Request for Proposals (RFP) for the River Road Feasibility Study.  The MPO has budgeted $60,000.00 for the project, and funding is available through the MPO account.

 

68.      Consideration to award a lease purchase contract for the purchase of forty-seven (47) Mobile Data Terminals (MDT) for the Police Department in the principal amount of $401,677.59, from Motorola Corporation, San Antonio, Texas and Portable Computer Systems, Golden, CO; and to authorize a contract with Sunguard H.T.E. Inc., in the amount of $158,280.00 for providing the application software needed to operate this equipment. Financing for the equipment will be secured through Kock Corporation. The lease purchase payments for the equipment and the application software cost have been allocated in the Police Trust Fund.  

 

69.      Authorizing the City Manager to continue using the Webb County Jail to incarcerate prisoners who are arrested for Class C misdemeanor violations, and to pay Webb County for these services at a rate of $49.43 per day per prisoner.  The daily rate is subject to change in accordance with the rate allowed by the United States Government for incarcerating federal prisoners in the Webb County Jail. The Webb County Jail is the only source that provides this service within our geographic area. Funding is available in the Police Department Budget.

 

70.      Consideration to award a professional service contract to Bexar County Forensic Science Center, San Antonio, Texas, in an estimated annual amount of $140,000.00 for criminal investigation laboratory services for the Police Department.  All services are requested on an as needed basis.  Services include examination of evidence involving: arson, controlled substances, DNA, firearms, tool marks, toxicology, serology, and other services required for criminal investigations.  Funding is available in the Police Department Budget.

 

71.      Authorizing the City Manager to enter into a one year service agreement with Sungard H.T.E., Inc. Lake Mary, FL, for the amount of $81,890.00 of which United Water will pay $20,305.00, and the City of Laredo will pay $61,585.00.  The service agreement is for service and maintenance on the municipal applications residing on the City’s I-Series 400 computer for the period of October 1, 2004 through September 30, 2005. Funding of the City’s portion is available in the General Fund – Management Information Systems.

 

72.      Consideration to award contract FY05-017 to the low bidders for the purchase of one hundred and twenty (120) sets of structural fire fighting protective uniforms for the Fire Department.  The set includes the fire coat, trousers, knee boots, gloves, hoods, suspenders and helmets.  This equipment will be purchased from the low bidders.  Funding is available in the Public Property Finance Contractual Obligation (PPFCO) Series 2002A bond.

 

73.      Refund of property tax in the amount of $4,069.80 to the following taxpayers and companies:

 

1.           A refund in the amount of $1,868.29 payable to Webb County Title due to an overpayment.  Account #101-00022-060.

2.           A refund in the amount of $685.72 payable to Colombus Energy Corp. due to an overpayment.  Account # M0-00597-514.

3.           A refund in the amount of $932.81 payable to Citifinancial Mortgage due to an overpayment.  Account # 549-01260-060.

4.           A refund in the amount of $582.98 payable to Laredo National Bank due to erroneous payment.  Account # 968-81001-020.

  

74.      Approving monthly adjustments to the tax roll.  The amount to be adjusted for the month of October 2004 represents an increase of $2,226.34.  These adjustments are determined by the Webb County Appraisal District and by court orders.

 

75.      Motion to waive bus fare collection to and from the HEB “Feast of Sharing”, Sunday, November 21, 2004 in support of the City of Laredo’s participation as co-sponsor of this event.  HEB will provide a $1,000 contribution to off-set the fares.

 

76.      Awarding a construction contract to the lowest bidder Jimmy Closner and Sons Construction Co., Inc., Mercedes, Texas in the amount of $1,986,553.25 for the construction of the Mines Road Work Order #2 - Water Main and Pump Station Project, subject to the approval of the TWDB. The Work Order #2 consists of installing a 16” PVC piping to provide a new water line from the existing 16” water line at Colonia Los Corralitos to Los Minerales and to Antonio Santos along FM 1472 and Las Tiendas Road. The construction time is 330 calendar days.  Funding is available in the Colonias Project Fund and Waterworks Fund.

 

77.      Authorizing United Water Laredo to provide all equipment and services to install and startup turbidity metering equipment in the amount not to exceed $108,127.00 to meet new Environmental Protection Agency (EPA) and Texas water monitoring requirements for the Laredo-Colombia Water Treatment Plant. This project is to be funded from Water Construction Division.

 

78.      Consideration to authorize a contract for bid FY05-021 for the purchase of promotional material for the 250th celebration from the low bidder.  Funding is available in the Convention and Visitor’s Bureau Budget.

XIV.     EXECUTIVE SESSION

 

The City Council hereby reserves the right to go into executive session at any time during this public meeting, if such is requested by the City Attorney or other legal counsel for the City, pursuant to his or her duty under Section 551.071(2) of the Government Code, to consult privately with his or her client on an item on the agenda, or on a matter arising out of such item.

 

81.      Request for executive session pursuant to Section 551.071(1)(A) of the Texas     Government Code, to discuss with the City Attorney the pending case of Martin     Villarreal, et al. v. City of Laredo, et al, Cause No. L-03-11, in the U.S. District Court, Southern District of Texas, Laredo Division [case pertaining to Los Obispos Affordable Housing Project]; and return to open session for possible action.

 

82.      Request for executive session pursuant to Texas Government Code Section 551.072 in order to deliberate the purchase and value on the pending negotiations for the acquisition of real property in vicinity of the Laredo downtown area, because deliberation in an open meeting would have a detrimental effect on the position of the City Council in negotiations with third persons; and return to open session for possible action.

2004-O-291                       Establishing rental rates on all multi-family apartment properties acquired in the Part 150 Airport Noise Compatibility Program, based at a minimum of the Fair Market Rents established by the U. S. Department of Housing and Urban Development (HUD), and establishing a rent deposit of $200.00 for said properties. Late fees will be charged at the currently established $5.00 per day after the 10th day of each month; the maximum days to be charged per month is twenty days. These units will be managed by the Laredo Municipal Housing Corporation (LMHC).
